Can an employer track my location in India?

It depends

For genuinely field-based roles, location capture tied to a specific purpose can be justified with proper notice. Continuous tracking of desk-based employees, or tracking outside working hours, is very hard to justify under the DPDP Act's necessity and purpose-limitation requirements.

Location data is personal data, and its processing has to meet the same DPDP Act standards as any other: a specified lawful purpose, notice, and collection limited to what that purpose requires. The lawfulness therefore turns on the role and the design, not on whether the employer disclosed it.

For field roles — service engineers, sales visits, site supervision — verifying that a visit happened at a customer location is a purpose an employer can articulate clearly. A single geotag captured at check-in serves it. Continuous background tracking through the day serves it no better while collecting far more, including the employee's movements between and after visits.

For desk-based and remote employees the necessity argument is weaker still. Knowing that a person worked a session on a project does not require knowing where they were, and coarse signals used to police home working tend to collect precise location as a by-product.

Two boundaries are near-universal in practice: tracking should not run outside working hours, and it should not continue when the app or device is not in use for work. An employer relying on location data should be able to state the purpose, the granularity, the retention period, and what less intrusive option was considered — the same documentation any proportionality assessment would require.
