Is a six-day working week legal in India?
Yes. Indian law requires at least one rest day in a week, not a five-day week. A six-day schedule is lawful provided weekly hours stay within the statutory ceiling — generally 48 — and every employee gets a weekly off, with substituted rest days where the off day is worked.
The statutory entitlement is to a weekly holiday, not to a two-day weekend. The Factories Act requires one day off in a week and regulates substitution where that day is worked; state Shops and Establishments Acts do the same for offices and IT establishments. A six-day week with 8 hours a day totals 48 hours and sits at, not beyond, the general ceiling.
The five-day week common in Indian IT is therefore a contractual and cultural norm rather than a legal requirement. That distinction matters in both directions: an employer cannot unilaterally move a contracted five-day week to six without varying the contract, and an employee on a six-day contract is not being treated unlawfully merely because peers elsewhere work five.
Where a six-day schedule does create legal exposure is at the margins. Working the weekly off without a substituted rest day, or letting a six-day week drift past 48 hours without paying overtime at double rate, are both contraventions. The Occupational Safety, Health and Working Conditions Code, 2020 continues the weekly-rest requirement.
The four-day week question is the mirror image: compressing 48 hours into four days runs into the daily-hours limit long before the weekly one, so it generally requires either reduced weekly hours or a state relaxation of the daily cap.
