Do I still need a muster roll if I use attendance software?
Yes — the obligation is to maintain the register, not to maintain it on paper. Indian labour rules increasingly permit registers to be kept electronically, so software satisfies the duty provided the record contains the prescribed particulars, can be produced on demand in the prescribed form, and is retained for the required period.
The muster roll — Form 25 under the Contract Labour (Regulation and Abolition) Central Rules, and its equivalents under the Factories Act and state Shops and Establishments rules — is a statutory register of attendance. What the law requires is that the register exists, contains the prescribed particulars, and is available for inspection. It does not require a bound paper book, and successive rule amendments have expressly contemplated electronic maintenance.
The Labour Codes push further in this direction, consolidating registers and returns and providing for maintenance in electronic or other prescribed form. The practical consequence is that attendance software does not remove the register requirement — it becomes the register.
That reframes the compliance question from 'do we need it' to three operational ones. Does the system hold every prescribed particular, including the ones nobody tracks by instinct such as the nature of work and the muster roll number? Can it produce the register in the prescribed format on the day an inspector asks, without a data project? Is it retained for the full statutory period, which commonly runs to three years or more depending on the rule?
Employers who answer yes to all three are usually better placed than paper-based peers, because an electronic register also carries the audit trail showing who recorded and approved each entry. Employers running software that cannot export the prescribed form are, in effect, keeping no register at all.
