Who can inspect attendance records in India?
Labour inspectors appointed under the applicable Act — factory inspectors, shops and establishments inspectors, and inspecting officers under contract labour and wage legislation — can require production of registers. Employees also have rights over their own records, and clients may have contractual audit rights.
The primary inspection power sits with officers appointed under the Act that prescribes the register. Factory inspectors under the Factories Act, 1948, inspectors under state Shops and Establishments Acts, and inspecting officers under contract labour and wage legislation can enter premises and require registers to be produced. The Labour Codes reframe some of this toward an 'inspector-cum-facilitator' model with web-based inspection schemes, but the production duty remains.
Refusing or failing to produce a register is itself an offence in most of these statutes, separate from any underlying non-compliance the register might have revealed. Records maintained electronically must therefore be producible in the prescribed form quickly — a system that holds the data but cannot render the statutory format is a practical failure to produce.
Beyond inspectors, two other categories of access matter. Employees have rights over their own personal data under the DPDP Act, including access and correction, so an employee asking for their own attendance history has a legal basis for it. And clients frequently negotiate audit rights over timesheets in services contracts — a contractual, not statutory, right that nonetheless produces real audits.
The common thread is that attendance records have several audiences with different formats. Building the register so it can be exported in the statutory shape, the client-audit shape and the individual-employee shape avoids a scramble each time one of them asks.
