# Attendance Policy (India) — Template

> Replace every **[bracketed]** value before use. This template is a starting
> point drafted for an Indian office or IT establishment. It is not legal advice,
> and it must be reviewed against the Shops and Establishments Act of each state
> you operate in before it is issued.

## 1. Purpose and scope

This policy sets out how working time is recorded, approved and used at
**[Company name]**. It applies to all employees at **[locations]**, including
those working remotely or from client sites. Contractors engaged through a
staffing partner are covered by their employer's policy; where **[Company name]**
is the principal employer, records are still maintained as required by law.

## 2. Working hours

- Standard working hours are **[09:30 to 18:30]**, **[five]** days a week.
- Contracted weekly hours are **[45]**, within the statutory ceiling applicable
  in **[state]** under **[the applicable Shops and Establishments Act]**.
- A rest interval of **[45 minutes]** is provided and is unpaid.
- Total daily presence including breaks must not exceed the spread-over limit of
  **[12 hours]** applicable in **[state]**.

## 3. Recording attendance

- Employees record work as sessions, starting a session when work begins and
  stopping it when work ends, selecting the project or activity it relates to.
- Attendance must be recorded on the day the work is performed. Records created
  later are less reliable and may be queried.
- Working from an approved remote location is recorded identically to working
  from an office. Remote days are working days.

## 4. Approval

- Sessions are reviewed by the reporting manager, ordinarily within
  **[three working days]**.
- A manager may query a session before approving it. Queries should be resolved
  by discussion, not by unilateral amendment.
- Approved records form the basis of payroll inputs, client billing where
  applicable, and the statutory attendance register.

## 5. Regularisation

- Where a session was missed or recorded incorrectly, the employee may submit a
  regularisation request with an explanation.

How to use it

  • Replace every bracketed value — the template deliberately fails loudly if you skip one.
  • Check the working-hours, spread-over and overtime figures against the Act applicable in each state you operate in.
  • Have counsel review before issuing. A policy is a contractual document once communicated.

This is a drafting starting point, not legal advice. Working-hours limits, overtime caps and deduction rules vary by state and have changed in several states during 2025 and 2026.
